1. Eligibility: The HMD Barbie™ Phone Competition (the “Competition”) is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of the date of entry. Employees, directors and officers of HMD America, Inc. (the “Sponsor”), its affiliates, subsidiaries, advertising and promotion agencies, suppliers, and each of their immediate family members (spouse, parents, children, siblings, and their respective spouses) and/or those living in the same household of each are not eligible to participate in the Competition. The Competition is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, including all interpretations of these Rules, as final and binding as it relates to the Competition.
3. Competition Period: The Competition begins on August 30, 2024 at 12:00:00 AM Eastern Time (“ET”) and ends on September 15, 2024 at 11:59:59 PM ET (the “Competition Period”).
4. How to Enter: How to Enter: During the Competition Period, visit https://www.hmd.com/en_us/beach-over-browsing (the “Website”) and follow the on-screen instructions to complete and submit the entry form to receive one (1) entry into the Competition. The entry must fulfill all Competition requirements, as specified on the Website, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may enter only once, and you must fill in the information requested. Automated entries are prohibited, and any use of automated devices will cause disqualification. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the Rules. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, uses fraudulent methods, or otherwise attempts to circumvent the Rules. Should multiple users of the same e-mail account enter the Competition, and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said e-mail account at the time of entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
5. Prizes (10) and Approximate Retail Value (“ARV”): Ten (10) winners will each receive an HMD Barbie™ Phone (ARV: $129.00) and be part of a 7-day challenge to disconnect and live your best life with the HMD Barbie Phone. Actual value of prize items may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prizes are nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winners. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted, except that if a prize becomes unavailable for any reason, Sponsor may award a substitute of equal or greater value in its sole discretion. The ARV of each prize item is based on available information provided to Sponsor and the value of any prize awarded must be reported for tax purposes where required by law.
6. Odds: The odds of winning depend on the number of eligible entries received during the Competition Period.
7. Winner Selection and Notification: Ten (10) potential winners of the Competition will be selected in a random drawing to take place on or about September 16, 2024, conducted by the Sponsor’s designated administrator / under the supervision of Case Dunlap Enterprises, LLC DBA TIC TOC from among all eligible entries received during the Competition Period. The decisions of Sponsor and/or its designated administrator are final and binding on all matters related to the Competition. Potential winners will be notified via email to the email address provided in connection with their entry within five (5) days following the winner selection. Potential winners will be sent an affidavit of eligibility/liability release and a publicity release (where permitted by law). Unless restricted by law, the potential prize winners will be required to complete and return the release documents within seven (7) days of receiving them. Sponsor shall have no liability for a potential winner's failure to receive notices due to spam, junk e-mail or other security settings or for potential winners' provision of incorrect or otherwise non-functioning contact information. If a selected potential winner cannot be contacted, is ineligible, fails to respond and/or claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed release documents as required, prize may be forfeited and an alternate winner selected in Sponsor’s sole discretion. Unclaimed prizes will not be awarded.
The receipt by a winner of the prize offered in this Competition is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE COMPETITION AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Detox Feedback Submission: Winners are encouraged to share their experience using the HMD Barbie™ Phone during their smartphone disconnect. Within fourteen (14) days following the conclusion of the disconnect period, winners will be asked to submit a brief report or testimonial detailing their experience, which may include how they utilized the suggested activities, the challenges they faced, and the benefits they observed. The feedback can be submitted via email to the Sponsor’s designated email address provided in the winner notification. While this submission is not mandatory, we would greatly appreciate your participation in helping us understand the impact of the disconnection. By submitting feedback, winners grant the Sponsor the right to use their testimonials in future promotional materials, subject to any required consent as provided in the publicity release.
9. Rights Granted by You: Except where prohibited by law, by entering this Competition you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Competition, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
10. Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Competition should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Competition. In such case, Sponsor may select the potential winners from all eligible, non-suspect entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Competition or website or violates these Rules.
Sponsor has the right, in its sole discretion, to maintain the integrity of the Competition, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site (including the Website) or undermine the legitimate operation of the Competition may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

11. Limitation of Liability: By entering you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Competition and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of the Website and/or any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Competition; (v) electronic or human error which may occur in the administration of the Competition or the processing of entries.
12. Disputes: THIS COMPETITION IS GOVERNED BY THE LAWS OF THE UNITED STATES, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Competition, each entrant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Competition, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Miami, Florida having jurisdiction. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than entrant’s actual out-of-pocket expenses (i.e. costs associated with entering this Competition), and entrant further waives all rights to have damages multiplied or increased.

14. Winners’ List: To obtain a copy of the winner's names or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: HMD America, Inc., 500 S. Dixie Hwy, Suite 201, Coral Gables, FL 33146. Requests must be received no later than October 31, 2024.
