Following terms and conditions (the “Terms and Conditions”) shall apply to the Free Nokia Comfort Earbuds offer (“Free Nokia Comfort Earbuds Offer” or “Offer”) detailed below. This Free Nokia Comfort Earbuds Offer is offered by HMD Mobile India Private Limited (“HMD” or “Organizer”).

The Offer shall be valid from 15th February 2023 until stocks last (“Offer Period”) for the first 50 completed pre- booking of Nokia X-30 (“Select Mobile Device”).

Under this Offer the first fifty (50) consumers who make a valid pre-booking and complete the purchase of Nokia X-30 upon availability of the same on https://www.nokia.com/phones/en_in (“Select Channels”) during the Offer Period shall receive a Nokia Comfort Earbuds (“Free Nokia Earbuds”) free with their purchase. This is a limited validity introductory offer and valid only for first 50 purchases made online through the Select Channels.

The Free Nokia Earbuds shall be dispatched along with Select Mobile Device for the first 50 consumers as a part of Offer. In the event the customer returns the Select Mobile Device, the Free Nokia Comfort Earbuds is also required to be returned. Failing to return the Free Nokia Earbuds shall enable HMD to take any actions it deems fit against the customer which shall include but not be limited to rejection of return request for the purchased Select Mobile Device.

This Offer is subject to fulfilment of terms and conditions of purchase by the consumer only. Consumers are required to prebook the Select Mobile Device within the Offer Period and complete all the requirements requisite to complete the purchase to avail the Offer.

This Offer is a limited period Offer, subject to local availability. HMD reserves the right to alter, amend, extend, withdraw, discontinue, or otherwise change the Offer/offers anytime during the Offer Period without any liability to any consumers.

By claiming this Offer, consumers understand that any personal data relating to the consumers who claim this Offer will be used solely in accordance with current data protection legislation and the HMD Privacy Policy- https://www.nokia.com/phones/en_int/privacyportal.

This Offer shall be immediately forfeited for the consumers who request for delivery of the Free Nokia Comfort Earbuds at any locations/pin codes which are not serviceable by HMD.

HMD shall not be responsible for any Free Nokia Comfort Earbuds which are undelivered or lost due to wrong/incomplete address provided by the consumer.

Subject to any applicable law: (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed by HMD including, but not limited to, meeting of the consumer's requirements or aspirations, timeliness, security, the results or reliability of the Free Nokia Comfort Earbuds Offer, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any Nokia products received under this offer (b) The consumer expressly agrees that his/her participation in this Offer is at the consumer's sole risk and is governed by the Terms and Conditions herein; and (c) No advice or information whether by representations, oral, written or pictorial derived from the website or through this Offer shall be construed to mean the giving of any warranty of any kind by HMD.

The Offer shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Offer and, or, pertaining to the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by the HMD. The venue of arbitration shall be New Delhi. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.

HMD will not accept any liability or responsibility for any damage, loss, injury or disappointment suffered by any consumer as a result of claiming the Free Nokia Comfort Earbuds or accepting the same.

The Free Nokia Comfort Earbuds is non-transferable and cannot be clubbed with the benefits under any other Contest, Offer or Competition organized by HMD. The Free Nokia Comfort Earbuds under this Offer cannot be exchanged for cash or kind, and no such requests will be entertained.
