Promotion period 26 November 2024 to 20 November 2025

The following Terms and Conditions apply to the above-named promotion and are subject to change without notice. The promotion is held by HMD Global.

About the promotion

In this promotion, Eligible customers who have purchased an HMD Fusion and HMD Fusion Gaming Outfit (“Eligible Device”) in selected Markets* from the Participating partners or HMD.com will be able to claim two months of Blacknut subscription for free by validating their device and sharing their email address on http://www.hmd.com/en_ie/blacknut-redemption.

• 2 months of Blacknut subscription for free for each purchase of an Eligible Device The Promotion period is from 26 November 2024 to 20 November 2025 and subject to the stock availability.

HMD Global and their rights as holder of the promotion

  1. HMD Global reserves the right at its absolute discretion to disqualify customers’ claims which it considers do not comply with these Terms and Conditions.
  2. HMD Global shall have the right, where necessary, to undertake all reasonable action to protect itself against fraudulent or invalid claims including, but not limited to, requiring further verification of proof of purchase, as well as the identity, age and other relevant details of a participating customer.
  3. HMD Global shall not be liable for any interruption to the promotion due to circumstances force majeure or other factors beyond the control of HMD Global.
  4. HMD Global reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to alter the Terms and Conditions of the promotion without notice.
  5. HMD Global will not be responsible or liable for the following: a. Any failure to receive claims form submissions due to transmission failures and other conditions beyond the reasonable control of HMD Global. b. Customer claims that are late, lost, misrouted, or damaged. c. Any malfunctions or failures pertaining to communications and the use of computers. d. Any disruptions, losses or damages caused by events beyond the control of the HMD Global. e. Any printing or typographical errors in any materials associated with the promotion.

”Eligible customer(s)”

To qualify for this promotion, customers must meet the following eligibility criteria:

  1. The customer must be a resident of the selected European Markets *, where the purchase and redemption happen in the same country.
  2. The customer must be over 18 years old as of the date of entry.
  3. The customer must purchase HMD Fusion and HMD Fusion Gaming Outfit. The HMD Fusion Gaming Outfit must be purchased during the Promotion period between 26 November 2024 – 20 November 2025 inclusively. HMD Fusion device may have been purchased before the start of the campaign.
  4. The customer must purchase HMD Fusion and HMD Fusion Gaming Outfit from the Participating partners or from HMD.com.
  5. The customer must be in possession of the purchased HMD Fusion device and HMD Fusion Gaming Outfit and must not have returned the device for a refund or exchange.
  6. Customers must submit a claim form for their 2 month free Blacknut subscription no later than 20 November 2025 23:59 GMT time, henceforth referred to as the “Redemption period”.

Responsibilities of the participating customer

  1. Participants will be solely responsible for any and all applicable taxes and any other costs or expenses that arise from participation of the promotion which are not stated in the Terms and Conditions as being included.
  2. By participating in this promotion, the customer agrees, to the extent permitted by applicable laws, to hold the promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the promotion. This includes, but is not limited to, awarding, acceptance, receipt, possession, use and/or misuse of the products included in this promotion.

Limitations of liability detailed in these Terms and Conditions shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of negligence on the part of HMD Global.

Restrictions

The promotion is subject, but not limited to, the following restrictions:

  1. Eligible customers will be able to claim a 2 month Blacknut subscription for free per one HMD Fusion and HMD Fusion Gaming Outfit purchase.
  2. The promotion is valid only while stocks last.
  3. Customers who purchase their HMD Fusion Gaming Outfit outside of the Promotion period are not eligible to enter this promotion.
  4. Claims submitted after the Redemption period will not be eligible.
  5. Claims form submissions that include incomplete, inaccurate or unintelligible information will be deemed invalid. HMD Global accepts no responsibility for lost, delayed or damaged data which occurs during transmission of the promotion claim.
  6. Employees or agents of HMD Global that are involved in the operation of this promotion or any other persons working on the promotion in a professional capacity are not eligible to participate in this promotion.
  7. Network providers, retailers, distributors, resellers and any person who purchases an HMD device and HMD Fusion Gaming Outfit for purposes other than to be the user of the product – for example, resale purposes – may not participate in this promotion.
  8. The 2 month free Blacknut gaming subscription is non-transferable and there is no cash alternative. In the event of unforeseen circumstances, HMD Global may substitute with one of equal or greater value.

How Eligible customers can claim their free 2 month Blacknut Subscription

Eligible customers will be able to submit a claims form during the promotion period by following the instructions on the redemption site: http://www.hmd.com/en_ie/blacknut-redemption.

Communication with the customer and confirmation of eligibility

After submitting the claims form, the customer of an Eligible Device can expect the following communication:

  1. The customer will receive a confirmation message on the redemption page shortly after submitting the claim form. The purpose of this message is to confirm that their claim was successfully submitted and what the next steps will be.
  2. The customer’s eligibility is checked using the IMEI code provided in the claims form. The customer’s eligibility is checked within 14 days of the claim form submission.
  3. Only if the customer’s claim is successful, will the customer be sent a code to the email they have specified in the claim form, which can be used activate the free 2 month Blacknut gaming subscription
  4. To claim the free trial, the customer must visit the specified page (as informed by HMD over email).
  5. The customer will be redirected to a page where they must enter the code received via email, followed by entering their payment method to complete the activation process.
  6. Subscription is provided by Blacknut. Using the code to activate the 2 months free subscription is subject to Blacknut terms and conditions, https://www.blacknut.com/en/terms

Please note that if a participating customer does not see the confirmation message on the redemption page, it means that the submission is not successful, and the customer will have to submit the claims form again until the confirmation message is visible.

All personal data will be processed in accordance with HMD Global privacy policy, available at https://hmd.com/privacy

Disputes

This promotion is governed by the laws of Finland. You irrevocably agree that Finnish courts shall have the exclusive jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Competition), and participant further waives all rights to have damages multiplied or increased.
